1. Acceptance of Terms

By using the Pandey Transport Services website (“the Site”), you agree to adhere to these Terms and Conditions. If you do not agree to any part of these terms, please do not use the Site. Your continued use of the Site constitutes your acceptance of these terms, creating a binding legal agreement between you and Pandey Transport Services (“Pandey Transport,” “we,” or “us”).

2. General Usage Terms

Pandey Transport Services manages this Site. By accessing or using it, you represent that you are at least 18 years old, fully capable of entering into binding agreements, and willing to provide accurate information when required. You also agree to abide by all applicable laws and regulations in connection with your use of the Site. If the information you provide is found to be false or misleading, Pandey Transport reserves the right to restrict your access or pursue legal remedies where necessary.

3. Modifications to Terms

Pandey Transport Services may update these Terms and Conditions periodically to reflect changes in our services, policies, or for legal reasons. Updates will be posted here and continued use of the Site after such changes constitute your acceptance of the revised terms. 4. Site Usage

Permitted Use: You are granted a limited, non-exclusive, non-transferable right to access and use the Site for lawful purposes in accordance with these terms. This license allows you to view, print, and download content solely for personal or non-commercial purposes.
Prohibited Conduct: You are strictly prohibited from using the Site in any manner that:
- Violates any applicable local, state, or federal laws or regulations.
- Involves hacking, unauthorized access, or tampering with the Site or its network infrastructure.

5. Vehicle Usage

Booking and Confirmation

All bookings should be confirmed at least 24 hours in advance to ensure availability.
A 50% non-refundable deposit is required at the time of booking to secure the vehicle.

Payment Terms

The remaining balance is due upon completion of service or before the transport commences, as per the arrangement specified at booking.
Any additional costs, such as tolls, state permits, or special delivery charges, will be billed separately unless specified in the initial agreement.

Service Commitment and Delay Penalty

We strive to deliver your goods on time. In case of any delay caused by us, we will impose a delay penalty as compensation. However, delays caused by factors outside our control (e.g., extreme weather, road conditions, accidents) are exempt from penalties.

Cancellation Policy

Cancellations must be made at least 12 hours before the scheduled pickup time. Cancellations made after this period will be subject to a fee equivalent to 25% of the total booking amount.
For cancellations made after the vehicle dispatch, the full booking deposit will be forfeited.

Liability and Insurance

Pandey Transport Services provides insurance coverage for goods transported; however, the liability is limited to the coverage terms specified at the time of booking
We are not liable for any indirect, consequential, or special damages, including loss of income or profit resulting from the delay or damage of goods during transit.

Customer Responsibilities

The customer is responsible for ensuring that goods are appropriately packed and prepared for transport.
The customer is required to provide accurate pickup and delivery locations, as well as any necessary permits or documentation.

Vehicle Arrival and Delay Penalty

In the event that the vehicle does not arrive at the agreed pickup time, Pandey Transport Services will impose a penalty, which will be adjusted in the final invoice.
Delays caused by the customer (e.g., loading time or incorrect information) are not subject to any penalties or refunds.

6. Intellectual Property

All content on the Site, including text, graphics, logos, icons, images, and software, is the property of Pandey Transport Services and is protected under copyright, trademark, and other intellectual property laws. The Pandey Transport name and logo, along with all related names, logos, product and service names, designs, and slogans, are trademarks of Pandey Transport or its affiliates or licensors. You are not permitted to use such marks without the prior written permission of Pandey Transport. Any unauthorized reproduction, distribution, or modification of Site content is prohibited and may lead to legal action.

7. Privacy Policy

Your privacy is important to us. Please refer to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Site, you acknowledge that you have read and understood the Privacy Policy, and you consent to the collection and use of your information as described therein.

8. Limitation of Liability

To the maximum extent permitted by law, Pandey Transport Services and its affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use or inability to use the Site, even if advised of the possibility of such damages. This includes but is not limited to damages resulting from errors, omissions, interruptions, deletion of files, delays in operation, or transmission, or any failure of performance, whether or not caused by events beyond Pandey Transport’s control.

9. Indemnification

You agree to defend, indemnify, and hold harmless Pandey Transport Services, its affiliates, and their respective employees, contractors, and agents from any claims, damages, liabilities, and expenses arising from your use of the Site or your violation of these Terms and Conditions.

10. Termination of Use

Pandey Transport Services reserves the right to restrict or terminate your access to the Site at any time, without notice, if we have reason to believe you have violated these Terms and Conditions or if your conduct might damage our reputation or operations. Termination of access may also occur if required by law or if Pandey Transport finds it necessary to protect its rights, property, or safety of other users.
